1. Purpose

Tellmestories, published by GUTENDEV, a limited liability company (EURL) with a share capital of €1,000, registered under SIREN number 849 274 758 with the Rennes Trade and Companies Register (RCS Rennes), with its registered office located at 28 boulevard du Colombier, 35000 Rennes, represented by Julien Blégean (hereinafter “the Publisher”).
and
any adult natural person or legal entity using the Tellmestories service via WhatsApp
(hereinafter “the User”).
2. Services Offered
Tellmestories is an innovative application that allows you to generate, via WhatsApp, personalized stories for children using artificial intelligence.
Key features include:
- Generation of personalized stories in quickly
- Customization: name, age, interests, favorite characters
- PDF download, printed book option
- Cumulative and unlimited credit system
3. Ordering and Functionality
3.1. Terms of Use
- Access to the service is exclusively via WhatsApp.
- A first story is offered as a free trial.
- Stories are generated based on the instructions provided by the User.
3.2. Nature of Generated Content
- Stories are generated automatically using artificial intelligence models.
- Tellmestories strives to provide quality content but cannot guarantee the complete absence of factual, grammatical, or narrative errors.
4. Pricing and Payments
4.1. Pricing
Applicable prices are those indicated on the website and at the time of order. They are expressed in euros (€), all taxes included.
4.2. Payments
- Payments are managed via Stripe, a PCI DSS certified platform.
- Bank details are never stored by Tellmestories.
- Invoices are sent by email upon request.
5. Credits and Refund Policy
5.1. Credits
- Purchased story credits are valid indefinitely.
- Credits accumulate and are never lost.
5.2. No Right of Withdrawal
In accordance with Article L221-28 of the Consumer Code:
“The right of withdrawal cannot be exercised for contracts for the supply of digital content not provided on a tangible medium, when the performance has begun after the consumer’s express prior agreement and express waiver of their right of withdrawal.”
Therefore:
- Once the story is generated, no refund will be granted.
- The User expressly acknowledges waiving their right of withdrawal by validating their order.
5.3. Refunds after Legal Period
- No refund will be granted after the expiration of legal deadlines, even in case of non-use of credits.
6. Intellectual Property
- Texts generated by AI are made available to the User for personal and family use.
- Any commercial use, reproduction, distribution, or modification for profit without written authorization is strictly prohibited.
- Tellmestories retains all rights to the technologies, algorithms, and databases used.
7. Liabilities and Warranties
7.1. Limitation of Liability
Tellmestories shall not be held liable for:
- Any errors, inconsistencies, or approximations in the generated stories.
- Any service interruption due to WhatsApp, Stripe, or network incidents.
- Any non-compliant use of the stories by the User.
7.2. Best Efforts Obligation
- Tellmestories undertakes to implement all necessary means to ensure service availability, without guarantee of result.
8. Personal Data
The collection and processing of personal data are governed by our Privacy Policy, in compliance with GDPR and the AI Act.
9. Force Majeure
Tellmestories shall not be held liable in case of non-performance due to a force majeure event as defined in Article 1218 of the Civil Code (e.g., global WhatsApp outage, cyberattack, natural disaster).
10. Amendments to the GTC
Tellmestories reserves the right to amend these GTC at any time. The new conditions are immediately applicable to new orders.
11. Applicable Law and Jurisdiction
- These GTC are governed by French law.
- In case of dispute, an attempt at amicable resolution will be made.
- Failing agreement, exclusive jurisdiction is attributed to the courts of Montreuil.
